Terms of Service

1. The Service

TextJoby lets you receive job listings by text message. When you text our number and opt in, we deliver job listings to you via SMS or other messaging channels, in some cases at or near the moment a listing is posted. TextJoby is an informational alert service only. We are not an employer, recruiter, staffing agency, or party to any employment relationship, and we do not guarantee that any listing is accurate, current, available, or that you will be hired.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the mobile number you provide belongs to you or that you are authorized to use it.

3. SMS / Text Messaging Terms and Consent

By texting our number or otherwise opting in, you expressly consent to receive recurring automated text messages from TextJoby at the mobile number you provide, including job listings, alerts, and related service messages. Consent is not a condition of any purchase.

• Message frequency varies and depends on available listings matching your interest.
• Message and data rates may apply. Check with your mobile carrier for details.
• To stop receiving messages, reply STOP at any time. You will receive one confirmation message and then no further messages, except as required to process your request.
• For help, reply HELP or contact us at support@rockywaterapps.com.
• We are not liable for delayed or undelivered messages, which depend on carriers and factors outside our control.

4. Your Responsibilities

You agree to use the Service lawfully and to provide accurate information. You will not (a) use the Service for any unlawful, harassing, or fraudulent purpose; (b) attempt to interfere with, overload, reverse engineer, or gain unauthorized access to the Service or its systems; (c) use automated means to access or scrape the Service without our written permission; or (d) use another person’s mobile number without authorization.

5. Job Listings and Third-Party Content

Job listings may originate from third parties, including employers and external sources. We do not author, verify, endorse, or take responsibility for the accuracy, legality, or availability of any listing. Any decision you make based on a listing, and any communication or dealing you have with an employer or third party, is solely between you and that party, at your own risk. We are not responsible for any loss or harm arising from those dealings.

6. Data and Privacy

Our collection and use of your information is described in our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge and agree that we may collect, store, and retain the data associated with your use of the Service, including your mobile number, message history, preferences, and usage data, for as long as we deem appropriate, and that we may use this data to operate, improve, and develop the Service and for the purposes described in the Privacy Policy. If you want your data deleted, you may request it by emailing support@rockywaterapps.com, as described in the Privacy Policy.

7. Intellectual Property

The Service, including its name, branding, software, and content (excluding third-party job listings), is owned by Rocky Water Apps and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service without our written permission.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT YOU WILL FIND OR OBTAIN EMPLOYMENT THROUGH THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKY WATER APPS AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Rocky Water Apps and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by replying STOP. Sections that by their nature should survive termination (including data, intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

12. Changes to the Service or Terms

We may modify or discontinue the Service, or update these Terms, at any time. If we make material changes, we will update the “Last Updated” date and may provide notice through the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in King County, Washington (which includes Bellevue, Washington) for any dispute not subject to arbitration or small-claims resolution.
